Acceptance of Terms

By creating an account or using the Barnabas Software platform (including pastoralcarepco.barnabassoftware.com), you ("The Subscriber" or "The Church") agree to be bound by these Terms of Service.

If you are entering into this agreement on behalf of a church or organization, you represent that you have the authority to bind that entity to these terms.

Description of Service

Barnabas Software provides a multi-tenant web application designed for pastoral care management, group tracking, and personal development (the "Service"). We reserve the right to modify or discontinue features to improve the software or comply with security standards.

Account Responsibilities

• Security: You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account.
• Authorized Users: You are responsible for all activity that occurs under your instance of the software, including the actions of staff or volunteers you authorize as users.

Use of the Service

• Lawful Purpose: You agree to use the Service only for lawful ministry and organizational purposes.
• Prohibited Conduct: You shall not:

  • Attempt to reverse-engineer or "hack" any part of the Barnabas Software infrastructure.
  • Use the Service to distribute "spam" or unsolicited commercial content.
  • Upload content that is illegal, defamatory, or violates the privacy of others.
• Pastoral Integrity: While we provide the tools, the Subscriber is solely responsible for the accuracy and ethical handling of the pastoral notes and member data entered into the system.

Data Ownership and Content

• Your Data: You retain all rights, title, and interest in the data you upload to the Service. Barnabas Software does not claim ownership of your congregation's information.
• Our License to Your Data: You grant us a limited, non-exclusive license to host, backup, and process your data solely for the purpose of providing the Service to you.
• Software Ownership: Barnabas Software retains all intellectual property rights to the software, logos, code, and design. "Barnabas Software," "Teach.It," and "GROW" are protected marks.

Fees and Payment

• Subscriptions: Access to the Service is provided on a subscription basis.
• Non-Payment: Failure to pay subscription fees may result in the suspension or termination of your access to the Service.
• Refunds: Subscription fees are non-refundable but may be canceled at any time.

Termination

• By You: You may terminate your account at any time by following the cancellation procedures in your dashboard.
• By Us: We reserve the right to suspend or terminate accounts that violate these terms or fail to pay for services.
• Data Export: Upon termination, you will have a period of 30 days to request an export of your data before it is permanently deleted from our servers.

Limitation of Liability

To the maximum extent permitted by law, Barnabas Software shall not be liable for any indirect, incidental, or consequential damages, including loss of data or loss of "ministry continuity," arising out of your use of the Service.

Indemnification

You agree to indemnify and hold harmless Barnabas Software and its officers (including Pastor Matthew Hon) from any claims, damages, or legal fees arising from your use of the software or any breach of these terms.

Governing Law

These terms are governed by the laws of the State of Texas. Any legal actions related to these terms shall be settled in the courts of Dallas County, Texas.

Program Description

Barnabas Software provides SMS alerts to ministry leaders and church members. These messages include transactional alerts such as account security codes, platform notifications, appointment reminders, and ministry updates specifically requested through your church's portal.

Message Frequency

Message frequency varies depending on your interaction with the platform and your church's specific settings. You can expect to receive automated messages when you trigger a platform action or when a ministry leader sends a direct update.

Message and Data Rates

Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Opt-Out Instructions

You can cancel the SMS service at any time. Just text STOP to the number from which you received our messages. After you send STOP, we will send you a confirmation SMS and you will no longer receive messages from us.

If you want to re-subscribe, simply sign up again through your church's portal and we will resume sending SMS messages to you.
